However, the rapid development and deployment of Generative AI have raced ahead of our ability to regulate and understand their impact. Addressing these issues is critical to ensuring that Generative AI remains a positive force for human progress.
Part 1: The Integrity Crisis – Misinformation and Deepfakes
Generative AI’s ability to create highly realistic content is its greatest strength, but also its most dangerous feature.
1. The Problem of Deepfakes
Deepfakes—realistic, synthesized videos or audio of people doing or saying things they never actually did—are becoming increasingly difficult to detect. LLMs can be used to generate convincing fake text messages, emails, or news articles, while image generators can create photorealistic scenarios.
Erosion of Trust: When we can no longer trust that a video or news report is authentic, the very foundation of public discourse and democratic processes is undermined. This is known as the "liar’s dividend," where real events can be dismissed as fake because the technology to create fakes exists.
Malicious Use: Deepfakes are used for financial fraud (imitating a CEO’s voice to authorize a transfer), character assassination, or political manipulation during elections.
2. Algorithmic Hallucinations
A unique problem with LLMs is that they sometimes produce confidently stated misinformation, known as "hallucinations." Because LLMs are trained to predict the next most probable word, they can generate completely false facts, citations, or even code, presenting them as truth. This makes them unreliable sources for critical tasks, especially in specialized fields like law or medicine, where factual accuracy is paramount.
Part 2: Bias and Discrimination in the AI Output
Generative AI models are trained on massive datasets scraped from the internet, which inevitably contain the entirety of human language, culture, and biases.

The "Fair Use" Debate: Legal battles are ongoing globally over whether scraping copyrighted material for AI training qualifies as "fair use" (a concept that permits limited use of copyrighted material without permission). Creators argue that the AI models directly compete with them using their own work, effectively devaluing their entire profession.
Attribution and Compensation: If an AI creates a piece of art heavily inspired by a specific artist's style, does the original artist deserve attribution or a royalty payment? The current legal framework is struggling to adapt to this new paradigm of creation.
2. Defining Originality and Authorship
When an AI writes a novel, creates a piece of software, or generates a marketing campaign, who owns the copyright?
The User or the Machine? Current copyright law requires a human author. Most legal systems treat the AI output as belonging to the user who wrote the prompt. However, defining the level of human creativity needed to claim authorship over an AI-generated work remains a challenge. If the AI does most of the creative heavy lifting, the traditional concept of authorship becomes blurry.
